Athens gang member receives 40-year sentence for child’s death

A member of an Athens gang has been sentenced to 20 years in prison for his role in a 2024 drive-by shooting that killed a child at the Hallmark Estates mobile home park.

Julian Omar Cubillos, a member of the Everybody Eats street gang last week pleaded guilty to voluntary manslaughter for his involvement in the shooting that took the life of 3-year-old Kyron Zarco Smith.

Cubillos had been in a car with three other EBE gangsters when they opened fire on a rival gang member who was sitting outside of a trailer. They missed the intended target and their bullets struck and killed the child who was inside the home watching television with his older brother, who was wounded.

Earlier this year EBE members Desmontrez Mathis, Jayden Brown, and Dakious Echols were convicted of murder for firing guns during the drive-by and they were sentenced to life in prison.

Prosecutors allowed Cubillos to plead to the manslaughter charge because they had no evidence that he fired a weapon.

In addition to the 20-year prison term he was sentenced to 20 years of probation.
