A Lexington man was arrested Monday for allegedly attempting to force his way into the Athens-Clarke County home of an ex-girlfriend who had a protective order against him and also uploaded onto the Internet a video of the woman performing a sexual act without her consent.
At the time, 58-year-old Franklin Leon Waller was on probation for a child molestation conviction.
Due to the nature of the allegations, a police incident report cannot be publicly released, according to Lt. Shaun Barnett, public information officer for the Athens-Clarke County Police Department.
However, Barnett provided a summary of the incident which reportedly occurred on Aug. 4 at the victim’s home in the town of Bogart in western Athens-Clarke County.
He said that Waller went to the victim’s home in violation of a temporary protective order issued by a Clarke County judge.
The suspect tried to kick in the victim’s door, but was unsuccessful, according to Barnett.
"Waller also uploaded a video of the victim performing a sex act without the victim’s consent,” Barnett said.
After an investigation, police obtained warrants charging Waller with aggravated stalking, criminal attempt at first-degree burglary, and distribution of obscene materials.
Additionally, when booked at the Clarke County Jail Monday afternoon, Waller was charged with a felony probation violation that stemmed from his November 2011 child molestation conviction in Athens-Clarke County.
According to court records, Waller touched the genitals of a girl under 16 years old.
As of Tuesday afternoon, Waller remained at the jail without bail being set for the probation violation, stalking and attempted burglary charges.
